What's the point of CCW now that we have constitutional carry?

Asking from a point of ignorance, not assholery.

This map makes it seem like an Ohioan can carry in any of the blue states without a CCW. I think green requires CCW?

The big thing for me is reciprocity. Ohio is one of the most powerful states in that regard allowing you to carry in all but 9 states

Yes. Every constitutional carry state allows non residents to carry as well.

Might look better in the court of law if you are ever forced to use it.

A licensed/trained person vs someone who never took the course.

I used to work in my LCS. With CCW, you still need to fill out the 4473 but we by-pass the NICS check (we don't send it out to FBI). So it's an instant approval from us.

Neither Cabela's nor the kitchen table FFLs I've used do. I mostly buy online at this point so I can't comment on mom and pop gun stores.

It depends on the mom and pop. I am an FFL, and so is my buddy. We both accept ccw permits and allow them to bypass the call-in/web check.

The explanation they give is that nobody is going around confiscating ccw’s if you catch a charge and the ATF under its current interpretation of the rules will still screw you for selling to a felon if they present a ccw and you bypass nics. That is an Ohio thing not a federal thing.

At least that’s what I was told.

School safety zones:

Permitless carriers may NOT carry a handgun in their vehicle when they drive into a school safety zone. Doing so is a felony under state and federal law.

This is the wild card. I guess if you permit less carry and are driving, you need to avoid school zones and I guess that’s “part of it” but seems so wrong IMO. Only problem if you do drive into one is if you get pulled over and tell the officer.

It's crazy that this isn't publicized more. And it's a FELONY? Seems like they baked in some gotcha type rules to permitless carry.

Yes I agree. Tbh I don’t think anything of it because I’m not committing any crimes, I don’t intend to use my firearm unless I absolutely have to. I feel like an officer who is 2A gung-ho , they’d educate you (if they even know) and let you go with a verbal warning. Idk

It's a big part of why I went ahead and got my CHL: pretty tough to get anywhere from my house without driving through at least one school safety zone.

No, you can't. The federal GFSZA (18 USC 922q IIRC) prohibits possessing a firearm in a school zone, which is defined as the school grounds and a 1000ft radius around the school grounds. There's an exception if you're on private land not owned by the school or if you have a CCW. There's a similar state law that covers school grounds, busses, and events, but does not include the area around them.

The federal GFSZA was ruled unconstitutional in 1995. To be honest, as a ccw holder, I don't know the final outcome because it no longer pertains to me.

It was ruled unconstitutional, then amended to include a clause saying it only applies to guns that have moved in interstate commerce. It stands as passed after the amendment.

This document from the Ohio AG very clearly says you can't drive into a school safety zone, which is 1000' around the school property.

I don’t think the 1000’ thing applies. It says something to the effect that for the purposes of the statute it includes up to the property boundary. So driving by you are OK but can’t pull into the parking lot.

woah WHAT? I've taken the classes and everything, all i literally have to do is go to the sheriffs office or whatever to get CHL and it lets me bypass the background check process at the gun store? Like I can just walk in, show my card, buy a gun and walk out??????

You still have to fill out the 4473 but they don’t run a NICS check on you. So as fast as you can fill out the 4473 and swipe your payment card, you can have your gun.

That depends on the gun shop. Need to ask the store if a filled out 4473, your CHL and cash gets you out the door without waiting for them to run the 4473

Vance Outdoors in ohio will absolutely still run the background check

FFLs are not obligated to bypass NICS with a valid CCW.

Most will but the big box gun sellers like RK Guns will not typically bypass the NICS check.

I always pass, so Im not super worried about it. Its just anxiety filling every time I go, like "what if they confused me with another pm_me_jupiter_photos" or something lol I usually shop at vances if you have experience there?

Me too. I think most of the gun shops I’ve used, even small ones, run NICs even with a valid CCW. As an aside, after filling the 4473, I’ve had two smartass gunshop clerks tell me I didn’t pass as I was picking up Ed Brown and Wilson Combat 1911’s on separate occasions. I have a sense of humor but not about that.

Vances will NOT bypass the nics check even if you have a CHL.

I get delayed 75% of the time. I have 2 Vances within 35 mins of me but i got tired of buying there only to be delayed.

So i will still buy there online and have it shipped to my LGS that is 5 mins away . Its worth the $25 transfer fee instead of waiting 3 days and making 2 trips to Vances.

Watch out carrying them in your wallet all the time. It only took mine 2 years for the licence number to wear off of it. I'm not saying don't carry the card but they don't hold up well if you are an active person.

Really? My first one held up pretty well over the 5 years but there was some fading. I only leave one card in each wallet sleeve, maybe that helped. It’s weird to think it’s optional to carry the card nowadays. I’m sure they can just look you up if there was ever any question but I think it’s a nice bonus to have on you. If you get pulled over, it’s essentially a “look, I’m not a criminal” card.

Huntington bank used to have the worst ATM cards. I no longer carry my bank card but their cards were always the first to bend and crack. Had to replace them on a 3:1 basis compared with everything else. Maybe because they aren’t meant to carry daily haha.

Everyone summed it up fairly well. The number 1 advantage is reciprocity. If you don't travel then the benefit is some gun stores will follow the law and skip the background check. Other than that not much, a second form of id?

Yeah i just tend to not stop and take the risk since most school zones are about 50 ft.. but to each their own

I don't think the law has been aligned between Constitutional Carry and Transportation of a Firearm, whereas a CCW provides rights in transporting your firearm when traveling in a vehicle, unless this has been changed in the past couple of months.

CCW allows for a firearm in a school zone (important if you are dropping off or picking up your kids), although you cannot bring your firearm into a school.

Reciprocity is the main one, if you frequently travel out of state for work your Ohio issued CCW will remain valid in many of those states. Personally I don't travel out of state often and was considering getting my CCW but coincidentally I heard that the Constitutional Carry bill was likely to pass so I just waited. You can always still take classes if you don't yet feel confident with your firearm and if you're going to, you might as well attain a CCW.

Its more of a "perk" than anything now, but I still retain mine.

If you get pulled over and have a gun, but have your ccw, cops are a lot more casual. You've taken the training to have your ccw, not just a completely random guy with a gun.

You can also buy guns with just your ccw. My state ID expired last year and I didn't realize it was the year for that. When I went to buy a birthday gun, I used my ccw license.

  1. It can speed up the transfer process with the right FFL.

  2. A person with a CCW can leave a firearm in the vehicle on school property in OH. You cannot legally do that with Constitutional Carry.

  3. CCW reciprocity with other states.

  4. The class gives you some training and information about the laws. (although some classes are better than others)

  5. I thought there was something about traveling with a firearm. If Constitutional Carry, the weapon has to be stored separately from the ammo. Hopefully someone can confirm or correct this.

If a cop runs your plate it comes up you have it, if you get out one cop harassing you bc they see you have it. Thats a win imo
