I’m glad NR has enough self-awareness to criticize Trump on this. But one thing that has never sat well with me was the notion that the Biden administration was engaging in lawfare at all, which NR was quite happily on the forefront of pushing.

Just because you prosecute your political opponent doesn’t mean it’s lawfare. There has to be room for the possibility that your political opponent did in fact commit a crime, and the rule of law demands there be room for investigating and prosecuting said crime.

The Biden administration followed all the standards for prosecuting a sensitive subject, sometimes to much criticism from liberals who felt the process was too slow. Biden had no involvement. The AG waited for Congress’s investigation to conclude. The AG appointed a neutral special prosecutor and otherwise did not micromanage the case.

They did this with the investigation against Biden himself as well. And did nothing to subvert the other Special Prosecutors investigating the Trump Dossier or Hunter Biden.

By constantly criticizing Biden’s DOJ for following the rules and norms as lawfare, NR left no room for legitimate investigations of political opponents. And, frankly, by accusing Biden of lawfare, they predictably have made it much easier for Trump to discard all those rules and norms to engage in a little lawfare himself. If you accuse Democrats of engaging in lawfare, then of course a vindictive Trump will want to do the same, never mind that it will be very different and far more corrupt than the Democrats’ version of “lawfare.”

I think this has been the fundamental issue with a lot of reporting medias, everyone receiving extremely criticism over the standard process and trump getting kid gloves for committing crimes, treason, and asinine ideas. Making the two seem equal.
