I don't see the current SCOTUS striking down the FFL requirement, so the third circuit likely won't either. That would be a big swing from a circuit. They may clarify what constitutes commercial versus personal sales.

Another argument RK has is opposing being photographed due to religious reasons but he never sought an exemption from that requirement. That makes that claim difficult, because the challenge he makes is not to the photography requirement, but that the photography requirement makes the FFL requirement facially unconstitutional, that's a hug stretch and the courts are not going to go for it.

I think an argument he could have is that the federal government can regulate interstate commerce, but if he only buys and sells guns within his state, then it is not interstate commerce and he should not be subject to the FFL system. Though he would have to buy his guns from resident persons or businesses in his state and sell them only to resident businesses or persons in his state.

It's an interesting case, but I don't see it going his way.
